ORDINANCE NO. 654 AN ORDINANCE TO AMEND ORDINANCE NO. 521 BY PROVIDING REGULATIONS ON THE SELLING OR GIVING AWAY CERTAIN ANIMALS; AUTHORIZING THE CITY POUNDKEEPER TO ADOPT PET SHOP REGULATIONS; MAKING IT UNLAWFUL TO KILL BIRDS: PROVIDING FOR PENALTIES FOR THE VIOLATION HEREOF; PROVIDING OTHER MATTERS RELATED THERETO; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. The Board of Commissioners of the City of Las Vegas do ordain as follows: SECTION 1. Section 42 of Ordinance No. 521 is hereby amended to read as follows: (a) Any person, firm, or corporation giving away baby chicks, rabbits, ducklings, or other fowl, or selling the same for a nominal price shall keep a register or record containing the signature and address of each person receiving such animals or fowl, together with a statement by the transferee that possession will not be in violation of the Zoning Ordinance, and in addition each transferee shall be furnished by the transferor with information as to the proper care and feeding of such animals or fowl. This subsection shall not be construed to prohibit the display or sale of natural chicks, rabbits, ducklings or other fowl, in proper brooder facilities by hatcheries or stores engaged in the business of selling the same to be raised for commercial purposes. (b) It shall be unlawful for any concessionaire of any carnival, fair, or other amusement park or amusement fair, to give as prizes in any game of chance, any live animals, birds, fish or reptiles, and it shall further be unlawful to use any animals, birds, fish or reptiles in said carnival, fair or other amusement place as targets, or in any unusual manner. This subsection shall not be construed to prohibit the display of animals, birds, fish or reptiles in proper facilities for educational or show purposes. Section 2. That the Clark County Humane Society, Poundkeeper for the City of Las Vegas, shall adopt rules an regulations for the operation of pet shops. Such rules and regulations shall first be approved by the Board of Commissioners. SECTION 3. No person shall kill any song bird or destroy or rob the nest of any such bird. SECTION 4. Any violation of this ordinance, or any provisions herein contained shall constitute a misdemeanor, and upon conviction thereof shall be punished by a fine of not to exceed Five Hundred $500.00 Dollars, and/or six (6) months in the City Jail, or a combination of both. SECTION 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 6. This ordinance shall be in full force and effect upon its final reading and adoption, and final publication as in the next section provided. SECTION 7. The City Clerk and Clerk of the Board of Commissioners of the City of Las Vegas shall cause this ordinance to be published once a week for two successive weeks immediately following its reading and adoption, in the Las Vegas Review Journal, a daily newspaper published in the City of Las Vegas.
