W» Bockes: Referring to your letter of September 9» 1946, your file 2160, concerning proposed organisation of a water district at Las Vegas, Nevada: I ; The proposed water district is being organised under the provisions of Senate Bill No. 63, Chapter 167 enacted by the Nevada Legislature approved March 27, 1947, entitled "An Act to create a water district in the Las Vegas Valley, Clark County, Nevada”, etc. Section 1 of the statute authorises the creation of a water district in Las Vegas Valley for the purposes, among others, of taking, by grant or otherwise, and to hold real or personal property necessary or convenient to the full exercise of its power} to acquire property of every kind; and to con** struct, maintain and operate works and improvements suitable for its objectives. / * 1 J The statute confers upon such district, authority to store water; to appropriate water and water rights; to have and exercise the right of eminent domain for condemnation of property necessary for its purposes "whether such property be already devoted to the same use by any district or other pub­lic corporation or,agency or otherwise, and.to condemn any existing works or improvements in said district now or here­after used," The statute also confers upon such district au­thority to construct, maintain and operate a complete system of water acquisition, storage and distribution. Under the statute the district comesinto being by way of petition signed by at least five per cent of the owners of real property within such district. The petition is re- If quired to be presented to the Board of County Commissioners of Clark County. It is my understanding that such a petition has been presented and approved. Pursuant to the statute an election to determine whether such district shall be organised is scheduled for October 19th, next. At such election directors will be selected for the district and in the event a majority of the electors vote in favor of organization of the district, the Board there­upon shall declare the district organized and the directors, elected as above stated, shall thereupon assume office.
