ms sheet 2 of (3 ) nm/r-m** / 2— j§ adjudged and decreed that they have 4$/l00 of cue cubic foot per second of the eaters of said Greek, during the portion of the year from May 30th until November 15th of each and every year, so long and during such portion of such tine as there shall flow in said creek at the head of what is known as the Stockton Ditch an amount of water equal to one and thirty five hundredths(1-35/100) cubic feet per second or acres That whenever the amount of water flowing during said period in eaid ereek at the place aforesaid shall aasount to less than 1-35/100 cubic fset per second the parties plaintiff and the persons whoa they represent as above set forth shall be entitled to take through their ditch one third of all the waters flowing or to flow in •aid ereek , and the said defendants shall be entitled to the remaining two thirds of said waters j that whsaever during said period of the year from May 30th to iovember 15th the waters of said Soldier Canyon Creek shall fall to such an extent that there shall be in said creek at the head of Stockton Ditoh no more than 5/10 of a cubic foot per second of water, the parties plaintiff and the persons whom they represent shall be entitled to the use of said waters for one third of the time — — that is to say, for one day out of every three days — and the parties defendant shall be entitled to the use of the whole of said waters for the remain* ing two thirds of the time, — that is to say, for two days out of every three days* Whenever the waters are divided as last above provided— that is to say, to the plaintiff*s one day out of three and to the defendant*s two days out of three** the defendants George Benton and John Benton and the defendant Elisabeth Wilson personally and as Executrix aforesaid shall be entitled to flow their proportion of the waters of the ereek through the Stockton Ditoh to suoh a point opposite to or upon the premises of the said Bentons and to suoh a point opposite to or upon the premises of the said Wilson as may be convenient to them respectively, the defendants shall not by virtue of the above provision acquire any right in or to the Stockton Bitch, but merely the right to flow the water hereby allotted to them when the waters of the entire stream are 5/10 of a cubic foot of water per second or lees. Whenever the allotment of water shall be by time as above set forth, the order of taking by the parties shall be; First, said defendant JUA*$cribner; second, said defendants Georgs Benton and John Denton; Third, said defendant Elisabeth Wilson personally and as executrix ; Fourth , the plaintiffs and the persons whom they represent* The said defendant Mrs* Elisabeth Alison for herself and ae executrix is hereby decreed the right to have a drinking stream out of the Stockton Ditoh alioted to her opposite to her place; the •aid stream to be l/20 of the entire flow in the Stockton Ditch where the same is diverted; To be allowed to her one day in three,
