% I 2 - along said north lino of said section to the place of "beginning, contain* ing an area of 12*7 acres, more or less* And, WHEREAS, the second party has notified said first parties of its intention and desire to exercise the option granted to it under said contract of February 15th, 1905, and is ready, able and willing to com­ply with the terms and conditions of said contract to be by it kept and performed} and, WHEREAS, the second party has indicated its willingness to accept a conveyance from the first parties of the remaining lands and the water rights described in said contract of February 15th, 1905, and to pay to the first parties the consideration named in said contract upon the condition that said first parties will proceed with all reasonable dispatch to acquire title to the lands herein described and convey the same by good and sufficient deed of conveyance when title is so acquired by them. IfOW THEREFORE, in consideration of the premises and of the payment to them by the second party of the consideration named in said contract Of February 15th, 1905, the first parties do hereby agree to proceed with all reasonable dispatch to acquire title to the lands herein described and to execute and deliver to said second party a good and sufficient deed of conveyance for said lands, conveying a clear and unencumbered title thereto when title is so acquired by them.
