Knlekerboeker* Unless the water company was n otified by the city or the contractor that grading would in terfere with the water mains at certain places, and requesting the water company to lower the same, the water company would not be lia b le to the contractor fo r any delay or damage suffered on account of necessary replacement o f water mains. I assume that the city engineer prepared plana and specifications which show the proposed street levels and the depth of excavations at certain places necessary for surface conformity. I understand that the water oozap&ny had no knowledge or notice o f the proposed excavations or that the pipes would be Interfered with, necessitating any replacement, u n til the actual excavations were made. fhe street paving contract, which should include plans, specification s, surveys, le v e ls, e t c ., was provided fo r and executed under an ordinance adopted by the city, a copy of which I do not have here. I am re ferrin g this correspondence with copy of this le tte r to Leo, fo r investigation on the ground. So long as the water company uses reasonable diligence in making replacement of water mains a fte r notice that same is required* i t is not lia b le , in my opinion, to the contractor for any delay occasioned thereby. Observing the matter from a practical standpoint the excavations made to conform to any levels suggested by the engineering department, seem unwarranted and unnecessary fo r drainage or fo r other purposes, under the climatic conditions of Las Vegas. f .
