Cory Attorney at Law Cornet Building, Fremont at Fourth Las Vegas, Nevada* Dear Mr, Cory: By today’s mail we received notice of intention to drill card from the Roscoe Moss Company stating that on or about September 25, 1954 they would commence the drilling of a new 16” well for the Union Pacific Railroad Company* I am wondering under what permit this well is to be drilled, I would appreciate your immediate advice. In connection with Application 15754, this was filed to change the point of diversion of 1,4 c.f.s. of the waters appropriated under Permit 15140, Permit 15140 was filed to change the point of diversion of 2,5 c,f.s, heretofore appropriated under Permit No, 7200 and Certificate 1631, It is my understanding that the new point of diversion under Permit 15140, which has been issued, is at the location of the old well in the railroad yards. As far as I know, the only well that can be drilled now is under Permit 15140, and as stated above, it is my^ understanding that a well already exists at this point. Do you intend to drill a new well at this point or to deepen the old well? No well can be drilled under Application 15754 until a permit has been issued and as this application has not as yet gone to publication, it would be three months or more before it would be ready for action. We started to write up the publication notice under Permit 15754 and then thought we had better wait until we had further advice from you. Under the rules and regulations as practiced by this office, based on our understanding of the ground-water act, before an application can be approved to change the point of diversion of ground water, the point of diversion from which the change is to be made must apply to a well already constructed and from which the necessary quantity of water can be obtained. Now in Application 15754 you desire to change 1,4 c.f.s, of water to a new point of diversion several hundred feet westerly* Also, in your letter of the 28th ultimo you state that you will prove up on 1,1 c,f,s* at the well represented by Permit 15140, This would indicate that you can develop 2,5 at the old yard well. However, before we could grant a permit to make such change we would like some evidence in the form of a statement that you can pump 2,5 c.f.s, from the well under 15140. For instance, if
