    Mr. E. E. Bennett: MAY 7 1945 Los Angeles - May 5th, 19*5' 1-733* (CO - Mr. W. R. Bracken Mr. Leo A. McNamee) Referring to Mr. McNamee's letter May 2nd in connection with application by Robert B. Griffith for appropriation of water adjacent to our water producing field at Las Vegas. I have always felt that our position in making this protest is an untenable one. If the statutes of Nevada recognized municipal use as of highest beneficial use, we would have some grounds for maintaining our posi­tion. However, I understand from Mr. McNamee that this is not the case. I think it would be well for Messrs. McNamee and Bracken to discuss with Mr. Ryland Taylor and Mr. Griffith the suggestion made by State Engineer Alfred M. Smith in his letter of March 3rd, that the Water Co. furnish Griffith water for his subdivision development at wholesale rates, but in any event I think the import­ance of Well No. 11 to our project is such that we should withdraw the protest.
