    TERMS AND CONDITIONS 1— Quotations are for immediate acceptance only and subject to change without notice. 2— Agreements are contingent upon strikes, fires, accidents, car short­age, or any other causes beyond our control. 3— Shipping promises count from receipt at foundry of full manu­facturing and shipping details; they are based upon present ex­pectations but are not guaranteed. Material in stock is offered subject to prior sale. 4— Delivery is to be made F. O. B. seller’s foundry, upon which seller’s responsibility ceases. 5— Freight charges, when included in the selling price, are to be paid by the buyer. Freight allowance is based on a specific rate to agreed destination and when shipments are forwarded freight col­lect the amount of freight is to be deducted by us on the face of the invoice. Consignee assumes the risk in paying any additional charges without our consent. 6— PAYM ENT: Net cash in Provo, Utah, unless otherwise agreed in writing. 7— CLAIMS: All claims for corrections or deductions must be made within ten days after receipt of goods. . All material is rigidly tested and inspected at the foundry and is carefully loaded. Seller agrees to replace at agreed point of de­livery any material proven defective, or which does not conform to the specifications shown in the order placed in acceptance of this quotation. The measure of the damage is the price of defective material only. No charge for .labor or expense required to repair defective ma-trial, or for any consequential damages, will be allowed. Claims for breakage or loss in transit must be filed with the car­rier’s agent promptly, as the Inter-State Commerce Commission prohibits carriers from paying loss or damage claims unless such claims are filed with them within four months after delivery date. It is impossible to collect for damaged or lost articles unless you have the original bill of lading and the original receipted freight bill with exception showing the loss or damage and signed by the carrier’s agent. In case of damage by the carrier, we will, if de­sired, make claim on behalf of our customers, provided we are supplied with the necessary data to substantiate the claim. 8— When orders have been filled as specified, no goods may be re­turned, nor will any credit be allowed, unless our consent has first been secured, and all goods returned will, if accepted, be credited less the cost of handling and the freight and cartage ex­penses incurred. 9— All orders submitted to us through our division sales offices, sales agents, or direct to the general office by the buyer, must be sub­ject to the approval of the Vice-President, Treasurer, or General Sales Manager of the Pacific States Cast Iron Pipe Company at Provo, Utah, for final acceptance. 10—Unless assented to by the proper official of our company, in writ­ing, no terms or conditions at variance with, or in addition to, those indicated herein shall apply to any transaction resulting from this quotation.- PACIFIC STATES CAST IRON PIPE CO. i
