Johnson Gentlemen: This Commission has for sometime been studying Rate No. 17, '’Concrete or Cement Work, per cubic yard, .06 per cubic yard," as indicated on Las Vegas Land and Water Company Schedule of Rates, Original Sheet P.S.C.N* No.2. In this study we acknowledge the assistance given by the Las Vegas Land and Water Company and have come to "the conclusion that the Young & Smith Ready Mix Concrete Company of Las Vegas has been paying a rate under the old tariff, which tariff was unreasonable and unjust to the Young & Smith Ready Mix Concrete Company, from September 1, 1951 to and including the present date, in that Rate No. 17 exceeded the rates as set forth in Rate No. 55a indicated on the First Revised Sheet P.S.C.N. No. 8. ? You are authorized to refund back to the Young & Smith Ready Mixx Concrete Company the difference between that which you have unreasonably collected since September 1, 1951 to and including December 1, 1952, upon which date the new schedule, known as Rate No. 55a, becomes effective by the order of this Commission.
