Mr. Knickerbocker; Referring to your letter of November l^th; Inasmuch as the use of water under this agree­ment has been discontinued, 1 suggest that notice be served on the Bear Canyon Pipeline Company by letter as follows: "Bear Canyon Pipeline Co., "Draper, Utah. "Gentlemen: "Referring to agreement made #uly 29, 1909, between Sear Canyon Pipeline Company and San Pedro, Los Angeles # Salt Lake Railroad Company, the pre­decessor of Los Angeles & Salt Lake Railroad Com­pany: "this is to advise that inasmuch as this company has arranged to secure water from other sources at Draper, Utah, the use of the water mentioned in the above agreement has been dis­continued, and for this reason the Los Angeles & Salt Lake Railroad Company now elects to ter­minate the agreement. "fill you kindly acknowledge receipt of this letter and confirm the election of termina­tion?" "Very truly yours," Although the agreement provides that six months written notice of its intention to terminate the agreement shall be given to the other party, still 1 am of the opin­ion, in view of the fact that the use of the water has been already discontinued and the small amount involved, that the matter may be terminated as set forth in above letter with­out the necessity of six months notice in advance.
