Your letters of August 16th and September 1* 1938, with respect to manner of reporting certain s ta tis tic a l information in our Annual Report of Water U t ilit y to the Public Service Commission of Nevada? In view of General Attorney McNamee’ s opinion referred to on page 3 of your le tte r of August 16, and the ruling of the Secretary of the Public Service Commission given in his le tte r of August 29, we now u derstand that the amount reported to the Commission as maximum water supply should include the amount u tiliz e d for Irriga tio n purposes at the ranch owned by the LVL&S Co., but should not include the water u tiliz e d or sold by the railroad ; that the water, used fo r railroad purposes should, however, be reported in a footnote fo r the information of the Commission, so that the total production of the water f a c ilit i e s may be ascertained frosn the Report. In order to insure that we ax© now in agreement as to the manner of reporting this Information, I am attaching a copy of page 13, "General S ta tis tic s", of the Annual Report, on which I have shown the information, based on figures for the year 1937, as we propose to report it in future. I w ill appreciate advice from you as to whether the proposed manner of reporting has your concurrence. In order to allow ample time after receipt of your annual advice of s ta tis tic s for compilation and issuance of the report, and fo r bringing up and disposing of any questions which may arise in connection with the information furnished, we should receive the data from you for each year, without special request from us, as soon as practicable after the close of the year, and I w ill appreciate your arranging with the Superintendent to furnish you with Information required from him, accordingly.
