Within the next few days* the board of Directors of the District will adopt its resolution ordering the issuance and sale of said bonds.. This resolution will fix. the terms and conditions of the bonds* provide for the levy of taxes if revenues are insufficient, and will establish certain bend funds and make covenants to Insure payment of principal and interest when due. The covenants are necessary to insure the marketability of the bonds and to assure bondholders that bond proceeds and revenues will be adequately protected. It is o u r understanding that under the Nevada. Constitution a special session of the Legislature may enact any legislation which the Governor sails to the attention'of the Legislature while in session. We strongly recommend that after the Board of Directors of the District adopt® its resolution authorising the issuance of said bonds, a validating act be passed at the special session of the Nevada Legislature confirming* validating and declaring legally effective all acts and proceedings taken by the District In connection with the authorisation* issuance and sale of said bonds. Under decisions of the Supreme Court of the United States and other courts of last resort, it is well settled that where the State Legislature at the tins© of original authorisation had the const!tution&l power to authorise the Issuance of bonds
