    AWARD OF BID No. 48.12 This being the time for the awarding of Bid No. 48.12 for an accounting machine, Accounting Machine said bid from the National Cash Register Company being the only bid received on August 6, 1948, Commissioner Whipple moved that the aforementioned bid in the amount of $3100.00 be approved. Motion seconded by Commissioner Clark and carried by the following vote: Com­missioners Clark, Moore, Whipple and His Honor voting aye: noes, none. Absent: Commissioner Baskin. PROPOSED ORDINANCE An ordinance entitled: AN ORDINANCE LICENSING, FOR THE PURPOSE OF REGULATION Real Estate Brokers AND REVENUE, REAL ESTATE BROKERS AND REAL ESTATE SALESMEN, AS THEREIN DEFINED, IN THE CITY OF LAS VEGAS; FIXING THE FEES THEREFOR AND OTHER CHARGES IN CON- NECTION THEREWITH; PROVIDING A PENALTY FOR THE VIOLATION OF ANY OF THE PRO­VISIONS THEREOF; REPEALING SUBSECTION 2 OF SECTION 8 of ORDINANCE NO. 244, AND ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH; AND OTHER MATTERS PROPERLY RELATING THERETO, was read by title to the Board and referred to Com­missioners Moore and Whipple for report. ORDINANCE NO. 359 An ordinance entitled: AN ORDINANCE OF THE CITY OF LAS VEGAS REGULATING THE 1st Reading APPEARANCE OF MINORS ON THE PUBLIC STREETS, AVENUES, ALLEYS AND OTHER PUBLIC PLACES WITHIN THE CITY OF LAS VEGAS; PRESCRIBING PENALTIES FOR THE VIOLATION OF ANY OF THE PROVISIONS HEREOF; REPEALING ORDINANCES NO. 9 AND 21, AND ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND OTHER MATTERS PROPERLY RELATING THERETO, was read by title on August 6, 1948 and referred to Commissioners Clark and Moore for report. The foregoing ordinance was re­ported on favorably by the committee, who asked that the age be changed from eighteen to sixteen years so that this ordinance would be uniform with County and North Las Vegas ordinances. Ordinance No. 359 was then read in full, for the first time. Thereafter Commissioner Clark moved that this ordinance be approved on its first reading. Motion seconded by Commissioner Moore and carried by the following vote: Commis­sioners Clark, Moore, Whipple and His Honor voting aye; noes, none. Absent: Com­missioner Baskin. ORDINANCE NO. 357 At this time George Marshall, Esq. appeared before the Board and asked that the 2nd Reading proposed Ordinance No. 357 be rejected. Not Adopted Thereafter Harold M. Morse, Esq. asked that said proposed ordinance be approved on its second reading. Thereafter Mayor Cragin instructed the City Clerk to read the following entitled ordinance to the Board for a second time: AN ORDINANCE TO AMEND SUBDIVISION NUMBER (77) OF SECTION 2 OF ORDINANCE NO. 359 OF THE CITY OF LAS VEGAS ENTITLED: "AN ORDINANCE TO AMEND SECTION 6, SECTION 8, AS AMENDED, AND SECTION 11 OF ORD­INANCE NO. 244 OF THE CITY OF LAS VEGAS ENTITLED: AN ORDINANCE OF THE CITY OF LAS VEGAS LICENSING FOR PURPOSES OF REGULATION AND REVENUE EVERY KIND OF LAWFUL BUSINESS HEREINAFTER SPECIFIED, TRANSACTED OR CARRIED ON WITHIN THE COR­PORATE LIMITS OF THE CITY OF LAS VEGAS, STATE OF NEVADA; FIXING THE RATES OF LICENSE TAX UPON THE SAME AND PROVIDING FOR THE COLLECTION OF SAID LICENSE TAX, AND A PUNISHMENT FOR CARRYING ON OR CONDUCTING ANY SUCH BUSINESS WITHOUT A LICENSE, AND REPEALING ORDINANCES NUMBERED 1, 2, 4, 13, 14, 35, 48, 62, 74, 75, 81, 95, 102, 105, 108, 112, 117, 145, l84, 192 AND 243. Commissioner Moore moved that the following opinion of City Attorney, C. Norman Cornwall dated August it, 1948 be included in these minutes: August 4, 1948 Honorable Mayor E. W. Cragin and Board of City Commissioners, Las Vegas, Nevada In re: PROPOSED AMENDMENT OF SUBDIVISION NO. 77OF SECTION 2 OF ORDINANCE NO. 349 OF THE CITY OF LAS VEGAS Gentlemen: Pursuant to your request for an opinion as to the constitutionality of the proposed amendment of Subdivision No. 77 of Section 2 of Ordinance No. 349 of the City of Las Vegas, which was prepared and submitted to your Honorable Board for passage by the law firm of Morse and Graves, I have researched the legal problems involved therein and submit the following. The problems involved in this proposed ordinance are: (1) Whether the legislative body (the Board of Commissioners of the City of Las Vegas) has the authority and power under its Charter to regulate businesses of all kinds, and (2) To what extent the said legislature can regulate the parti­cular type of business covered in said proposed ordinance, and
