Under franchise procured in 1909 by Water Company fo r Clark's las Yegas fownsite we are not required to make distribu tion as a public u t ilit y outside o f boundaries of Clark's o rig in a l townsite;' fo r this reason we have each contract provide that by reason o f furnishing water to subdivisions outside o f o rig in a l townsite we do not become a public u t ilit y fo r subdivisions outside o f origin a l franchise grant. Should we make extension now and serve any sub­d ivision other than origin al towasite, i t would act as a waiver and we would be required to serve any person demanding water however remote and unprofitable the servioe might be. 7. Based on average population 1928 o f 4500. use o f water per capita amounted to 325 gallons per day which compares with 670 gallons at Beno, Bevada, where conditions are somewhat sim ilar to those at las Yegas. Many towns of same size use more water than does las Yegas* and consideration should be given to our policy which, up to the,present time, has been to furnish a l l water required at a nominal cost in order that lawns, shade tree s, eto., w ill be taken care o f and more pleasant surroundings provided fo r employes o f Bailroad Company. While present franchise was secured from County, new franchise in 1934 w ill be secured from C ity o f las Yegas. Public Service Commission has gurisdiotion over rates, necessity fo r increase in rates could not be shown
