Union Pacific Railroad Co. 422 West Sixth St. Los Angeles 14, California Dear Mr. Bennett* Reference 1* made to your letters of November27andDecember 20 concerning my testimony as a witness on tha ;part of tlie Las Veaas Land and Water Company in connection with Case no. x<ix*t, As^you were advised by my letters of November 30 and _ 26, your request was referred to the Director of th. Geological Survey for instructions. Just recently a reply to this request was received, a copy of which is enclosed. You will note in the second paragraph of the repiy that the_ Director is somewhat confused concerning the name of the Pacific Railroad. In review of my correspondence, I apparently neglected to inform him that the Las Vegas Land and Water Co. is a subsidiary of the railroad. However, the pertinent part of the letter with £®*P®®b b0 testimony is contained in Paragraph 3. As you will note, the Director desires that my services as such a witness be notmade available unless an affidavit is submitted s®ttingforththe interest of the litigant and <the information with respect to which my testimony is desired. In view of this decision, it is believed that it would be advisable for you to prepare such an affidavit and forward It directly to the Director, D.3. Ooologlcal Survey, General Services Building, Washington 25 •* copies to Mr. A.N. Sayre, Chief, Ground Water Branch, at the same address and to me at my Carson City address. You will note that the Director takes exception to my J®^®®* as an expert witness with reference to some Issues of the case. I believe, however, there is no objection to my testimony on factual data.
