1 2 3 4 5 6 7 8 9 10 11 12 1 3 1 4 1 5 1 6 1 7 1 8 1 9 20 21 22 2 3 2 4 2 5 2 6 shop grounds and railroad yards at las Vegas, Nevada, and to secure from the State Engineer of the State of Hevada the right to transfer the right to appropriate water above referred to from Well No. 1 located upon the said land tinted in pink on Exhibit *'&" to an existing well and an additional well or wells located upon their property in the vicinity of the shop grounds and railroad yards at las Vegas, Nevada, All of the parties hereto propose to enter into a contract with IAS VEGAS VALLEY WATER DISTRICT, a public corporation of the State of Nevada, hereinafter called "District”, for the sale to the District of all of the above mentioned water production,storage and transmission facilities and also the water distribution system now owned, operated and maintained by the Water Company for the distribution of water as a public utility at Las Vegas, Nevada. In said contract with the District the parties hereto will agree that if Salt Lake Company shall convey the lands tinted in pink on Exhibit RA* prior to the sale thereof to the District, Salt Lake Company will insert a covenant running with the land in the deed conveying said land for the benefit of the land conveyed restricting the drilling of water wells by Salt Lake Company, its successors and as signs, upon certain other land now owned by Salt Lake Company. Accordingly Salt Lake Company has inserted such a covenant in the deed conveying to Union Paelfle the land shown tinted in pink on Exhibit MA % In the deed by which the Union Pacific is conveying said land to the Water Company Union Pacific is assigning to the Water Company all of its rights and interests in and to the said covenant restrict 3
