Los A ngeles, Hotember 5 th , 1915* F ile E-262 Weights - Applicable on o ils viz* petroleum and petroleum products transported in tank cars* Hr* Kelby: Our T a r iff Sl£ 107-C provides that the weights and charges fo r commodities in tank oars w ill be based on f u l l gallonage capacity per tank* This item in the t a r i f f refers to our C ircular SLR 171-F fo r reference to gallonage capacity* C ircular 171-F, under caption "F u ll Capacity", c arries two columns* one showing the capacity of the s h e ll, the other column showing the capacity of the dome* yhft Interstate Commerce Commission regulations for the transportation o f explosives and other dangerous a r tic le s by freigh t* provides that tank oars may not be loaded above 98% of th eir capacity with shipments of o ils o f inflammable nature* Our t a r i f f was amended September 7th* making provision fo r assessment of charges on 98% of the capacity of the tank on inflammable liq u id s , but prior to the time th is amendment was made to the t a r i f f * numerous shipments moved and we are now confronted by the following questions Can we assess charges on the basis of 100% of the capacity of the tank when our t a r i f f s so provide* even though the 1*0*8* regulations prevent the shipper from loading the tank beyond 98% of th is capacity* W ill you please favor me with your opinion in connection with th is question* For your information, my entire f i l e on this subject is attached hereto* and I w i ll thank you to return same with your reply*
