Bennett: Referring to your memo regarding the application of Playeide Kaufman for wate* Place, service to Lot Park Commissioner Williams was in during last week and I understand from him that Mr. Smith will be here March 8th on another hearing, but nothing definite on the arrival of Mr. Sexton for eoae time. We went over the map which indicated the oloseet main of the water company was about §00 ft. distant, whereas the main of the Boulder Syndicate on Division Place was 191 ft. distant. 1 explained we had received no application from Placide Kaufman and therefore did not know how many houses he intended to build thereon, and no mention was made of advancing the cost thereof, that our understanding was we were not permitted to use more than 80 ft. of pipe for each house, and under those circumstances doubted whether the War Production Board would let ue extend service that far when & closer source was available, I advised him I had also talked with Mike Paps who had refused service on the ground that he did not have a franchise in that territory. Mr. Williams exhibited a copy of the 1920 Water Law which provided a utility did not have to have & franch!ee to serve territory which was contiguous to the territory they were serving.
