ORDINANCE NO. 559 AN ORDINANCE TO AMEND SECTION 1 OF ORDINANCE NO. 508, ALSO KNOWN AS CHAPTER 36, SECTION 41, CODE OF LAS VEGAS, NEVADA, 1949, BY PROVIDING FOR SPEED LIMITS ON THE PUBLIC STREETS WITHIN THE CITY; TO AMEND CHAPTER 36, SECTION 42, CODE OF LAS VEGAS, NEVADA, 1949, MAKING IT UNLAWFUL FOR ANY PERSON TO DRIVE A MOTOR VEHICLE UPON A PUBLIC STREET WHILE INTOXICATED OR UNDER THE INFLUENCE OF INTOXICATING LIQUORS OR STIMULATING OR STUPEFYING DRUGS; TO AMEND CHAPTER 36, SECTION 54, CODE OF LAS VEGAS, NEVADA, 1949, BY PROHIBITING "U" TURNS ON CERTAIN STREETS AND INTERSECTIONS; TO AMEND CHAPTER 36, SECTION 126 BY PROHIBITING DRIVING A MOTOR VEHICLE WITHOUT BEING PROPERLY LICENSED; PROVIDING FOR FINES AND PENALTIES UPON CONVICTION; PROVIDING FOR OTHER MATTERS PROPERLY RELATED THERETO; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. The Board of Commissioners of the City of Las Vegas do ordain as follows; SECTION 1. Section 1 of Ordinance No. 508, which is also Chapter 36, Section 41, Code of Las Vegas, Nevada, 1949, is hereby amended to read as follows; It shall be unlawful for any person to ride, drive, or propel any vehicle at a rate of speed greater than fifteen (l5) miles per hour during school hours on streets adjoining school grounds occupied by a school ; building; or to propel any vehicle at a rate of speed greater than fifteen (15) miles per hour within any street intersection of any of the streets in the City, except on a through street or a street with traffic control signals, or to propel any vehicle at a rate of speed greater than fifteen (15) miles per hour on any street or alley within the City less than thirty (30) feet in width; or to propel or drive any vehicle at a rate of speed greater than twenty (20) miles per hour along Fremont Street between Main Street and 12th Street; or to propel or drive any vehicle at a rate of speed exceeding thirty-five (35) miles per hour along Rancho Road from Charleston Boulevard to Bonanza Road, along the Tonopah Highway to the City Limits, along Main Street from Charleston Boulevard south to Fifth Street or along South Fifth Street from the intersection of South Main Street to the South City Limits; or to propel or drive a vehicle at a rate of speed exceeding twenty-five (25) miles per hour on any other street or highway within the limits of the City except as hereinabove provided. Any person who shall violate any provision of this section shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not more than five hundred dollars ($500.00), or by imprisonment in the City Jail for not more than six (6) months, or by both such fine and imprisonment; upon a second conviction of an offense under the provisions of this section the person so convicted shall be punished by a fine of not more than five hundred dollars ($500.00), or by imprisonment in the City Jail for not more than six (6) months, or by both such fine and imprisonment, and in addition thereto his license to operate a car or motor vehicle within the city may be revoked for a period in the discretion of the Court not to exceed thirty (30) days; upon a third conviction of an offense under the provisions of this section, the person so convicted shall be punished by a fine of not more than five hundred dollars ($500.00), or by imprisonment in the City Jail for not more than six (6) months, or by both such fine and imprisonment, and in addition thereto, his license to operate a car or motor vehicle within the City of Las Vegas shall be revoked for a period of not less than thirty (30) days nor more than one (l) year. SECTION 2. Chapter 36, Section 42, Code of Las Vegas, Nevada, 1949, also referred to as Section 33, Ordinance No. 351, is hereby amended to read as follows; It shall be unlawful for any person or persons, while either intoxicated or under the influence of intoxicating liquor, or of stimulating or stupefying drugs, to ride, drive or conduct any vehicle, or have charge or control of any vehicle, on any public street within the City. Any person who shall violate the provisions of this Section shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than one hundred dollars ($100.00), nor more than five hundred dollars ($500.00), or by imprisonment in the City Jail for not less than thirty (30) days, nor more than six (6) months, or by both such fine and imprisonment, and in addition thereto, the person so convicted shall be deprived of his license i to operate a motor vehicle within the City for a period of not leas than thirty (30) days nor more than one (l) year; upon a subsequent conviction for an offense under the provisions of this section, the person so convicted shall be punished by a fine of not less than one hundred dollars ($100.00), nor more than five hundred dollars ($500.00), and by imprisonment in the City Jail for not less than thirty (30) days nor more than six (6) months, and he shall be deprived of his license to operate a motor vehicle within the City for a period of two (2) years. SECTION 3. Chapter 36, Section 54, Code of Las Vegas, Nevada, 1949, is hereby amended to read as follows; It shall be unlawful for any person owning, driving or permitting the driving of any automobile or other motor-propelled vehicle to permit the same to make a BU" turn at any place except at the intersection of streets; provided, however, that all such "U" turns are prohibited inside the central traffic district; and provided further that all such "U" turns shall be made in a careful manner and with due regard to the safety and convenience of pedestrians and all other vehicles upon such streets. Any person violating the provisions of this section shall be guilty of a misdemeanor, and shall be punished by a fine of not more than five hundred dollars ($500.00), and by confinement in the City Jail for not more than six (6) months, or by a combination of both. SECTION 4. Chapter 36, Section 126, Code of Las Vegas, Nevada, 1949, is hereby amended to read as follows; It shall be unlawful for any person to operate a motor vehicle upon a public street within the City without being the holder of a valid operator's or chauffeur's license. Any person convicted of violating the provisions of this section shall be guilty of a misdemeanor and shall be fine in the sum of not less than twenty-five dollars($25.00) nor more than one hundred dollars ($100.00) and in addition thereto, the person convicted shall be required to obtain a valid operators or chauffeurs license or produce a notice of dis­qualification from the Motor Vehicle Department of the State of Nevada. Any person whose operators or chauffeurs license has been revoked, who shall drive a motor vehicle upon a public street within the City of Las Vegas while said revocation is in effect, shall be guilty of a misdemeanor and upon conviction thereof shall be punished., by a fine of not less than, one hundred dollars ($100.00), nor more than five hundred dollars ($500.00), or by imprisonment in the City Jail for not less than thirty (30) days nor more than six (6) months, or by both such fine and imprisonment. SECTION 5. The Municipal Judge in imposing sentence for the violation of a provision of this ordinance shall not suspend the same nor any part thereof and it shall be his duty upon the revocation of the operators or chauffeurs license, within five days, to forward a record of the conviction to the Motor Vehicle Department of the State of Nevada, SECTION 6. This ordinance shall be in full force and effect upon its publication as in the next section provided, and final passage.
