Las Yegas, Nevada, August 15, 1959. Mr. E. US I Bennett: Miss Tiza Stewart, Mrs. Eva Stay and Mrs. Mina Stewart were in to see me yesterday concerning water for tiie four acre Stewart burial plot. Miss Tiza Stewart informed me that she had called Mr. Strong’s office in Los Angeles two or three weeks ago and by him had been referred back to me. At the time of the purchase of the Las Yegas Ranch and water rights, there was reserved by the Grantors four Miner’s inches of water, or so much thereof as might be necessary to irrigate the Stewart burial plot. Every summer for the past several years the Stewart heirs have complained to Mr. Bracken or myself regarding this water. In the summertime there is.not sufficient water going down the creek to reach the four acre plot. They claim that during the past two years two apple trees, one plum tree, one pear tree, and two fig trees have died for lack of water and that all the grass in the plot is dead. Mrs. Mina Stewart claims that except for about two days, namely, June 17th and 18th, there has been no water in their ditch since April 6, 1939. Mr. Bracken, Mr. Folger and I went over the ground about three weeks ago and there was no water in their ditch at that time, nor was there any water at the headgate of their ditch, and while the grass in the plot appears to be dead, I am not certain about the fruit trees. There are several old dried out and dead fruit trees in the vicinity but whether they are located in the four acre plot to which this reserved water is appurtenant, I am unable to determine .
