You accept and hereby agree to fully and faithfully comply with'all of the provisions of the Nevada Industrial In­surance Act, and that before the commencement of any work under this letter agreement, you will deliver to the Nevada Industrial Commission, a notice duly executed by you to the effect that you accept the provisions of said Act and any subsequent amendments thereto, and further you agree to indemnify and hold harmless the Water Company from and against all claims, demands, payments, suits, actions, proceedings, recoveries, awards and judgments of every nature'and description, including attorneys’ fees and cost pre­sented, brought or recovered against the Water Company, which may arise or grow out of any of the work performed under this agreement. 9. It is understood and agreed that you will commence work within thirty (3 0 ) days from and after the date of this letter agreement and shall handle the work hereunder in an expeditious and workmanlike manner to the satisfaction of the Vice President of said Water Company, or his representative. 10. It is agreed and understood that your employees are not and shall not be considered as emploj^ees of the Water Company. 11. The location of the line of the trench for said water mains and laterals in the streets and alleys specified here­in, the depth of said trench, the'size of the pipe to be laid in the respective streets and. alleys, shall be as designated from time to time by the Vice President ®f the Water Company, or his authoriz­ed representative. 12. You further agree to furnish surety bond in an amount not less-1han FIVE'THOPSANB SEVEN HCNSBED TWENTY-POUR Dollars, ($ 5 -7^4^00 "), in the’ form attached hereto and conditioned upon the xaiunrul performance of the work herein contemplated, 13. You shall procure, and cause each subcontractor, if any, to procure from a duly licensed'agent of an insurance company to be designated by the Water Company, Contractor’s Public Liability and Contractor’s Property Damage Insurance, The policy or policies to be taken out by you shall pro­vide limits (which have been designated by you) (a) under Contractor’s Public Liability Insurance, of $2 5 ,000.00 for any'one person; and subject to the same limit per person, $50,000,00 for any one accident; such insurance to protect you and each subcontractor against claims for injuries to or death of persons, other than your own employees, arising out of the work to be perform­ed under this contract; and •(b) under Contractor’s Property Damage Insurance, of $5,000,00 for anyone accident, and subject to the same limit per accident, $10,000.00 aggregate during an annual period. 3
