X appreciate the fact that we are already required to grant such refund under the provisions of Buie 9-G, recently approved by the Commission. The purpose of the proposed contract Is to permit us to do so, which we cannot do at present because the deed reads that the pipelines will be laid "at the cost and expense of Grantees, their heirs, executors, administrators, etc.® While the present contract with Biltmore Hemes, Inc. takes care of the refund on the first 20 acres, the deed prevents such refund arrangement on the balance of acreage, and this is why we wish the contract drawn. fill you kindly prepare a draft which we will submit to Mr, Bennett before final preparation.
