L a s V egas V alley W ater D istrict - pg. 3 5 /4 /5 3 so diverted is from an underground source, and the wells are located in the NE^SE^: of Section 27, Tp. 20 S ., R. 61 E ast. The place of use of both is in Section 26 of said Township. The first of said wells was put down to provide stock watering on the Vegas Ranch, with a priority of November 9, 1933. The second well has a priority of May 20th, 1948, and was to be used for irrigating a part of Vegas Ranch, 3. In Section 2 of the Contract, the railroad company reserves for railroad purposes and domestic use 2 .5 cfs. of water, which was allowed to it under Application No. 7200, and which supply comes from said Well N o.l, According to the Contract, the Railroad will reserve the right to that amount of water for said purpose, but will ask permission to change the point of diversion from Well No.l to the existing well on the railroad shop grounds, or it may drill an additional well or wells in the shop grounds to obtain the water so reserved. 4. The Las Vegas Land and Water Company does not have a franchise in the City of Las Vegas. It does, however, have a permit from the city to use the steets and alleys for the laying of water mains. The City Charter does not authorize the granting of franchise for water. It is my opinion that the D istrict need not procure any rights from the City, inasmuch as Section 19 of the Act creating the Las Vegas Valley Water D istrict, as amended by the 1951 Statutes of Nevada (1951 S ta ts.484) Provides: "The provisions of no other law, either general or local, except as provided in this A ct, shall apply to doing of the things herein authorized to be done, and no board, agency, bureau, or official, other than the governing body of the D istrict, shall have any authority or jurisdiction over the doing of any of the acts herein authorized to be done", etc. F urtherm ore: "There is hereby granted to said D istrict the right to own and operate its water distribution system within the boundaries of any municipal corporation lying wholly or partly within the boundaries of the d istrict", etc.
