No handling (A charge o f 50 cents shall be made for the ser- . . vice of turning water on and off and attaching me­ter*) A ll single packages, in excess of 6,000 pounds weight,' or 80 cubic . feet, in size, may be handled by special: contract at handler’s option, providing that no charge shall exceed 26 cents tor wharfage, and $2.26 for handling, per ton, or per 40 cubic feet. The rates for wharfage herein pre­scribed are for wharfage for a period not. exceeding twenty-four (24) hours, except in the event that good®, are held subject to rules and regulations of the United States Customs, such wharfage shall be for a period of forty-eight (48) hours; and if any commodity or merchandise for which wharfage is charged, as-herein pro­vided, is not removed .within said time from any wharf, the wharf owner or operator shall be entitled to receive, and shall collect an additional ajmount equal to said wharfage rates for such commodi­ty or merchandise for every twenty-four (24) hours or fraction thereof, during which the said commodity shall remain . upon such wharf in excess o f twenty-four (24)* hours or forty-eight (48) hours, re­spectively, as herein specified. Charges referred to herein represent the entire amount which may be collected for movement of fre ig h t. or merchandise over wharves, except in the event o f any freight being warenoused. in transit ow­ing to Customs regulations and require­ments, or through the negligence of con­signee in . not furnishing distribution o r­ders .prior to arrival of vessel, an addi­tional amount not exceeding fifty per cent (50%) of the handling charges scheduled herein may be collected to cover cost of such service, but in the event of said freight remaining in storage such extra handling charge shall he absorbed in the rate charged for storage. Sec. 2. That for the use of any wharf the person, firm or corporation owning or operating the same, is hereby authorized to charge the- owners of ‘ vessels for the privilege of making fast to said wharves the following rates,' commonly called “ dockage” , to wit.: ~ Rates of Dockage: Under 10 tons . . . . . . .... ........ ' 14.00 1801 tons to 2100 tons ..... .. . 15.00 .One-half cent per ton for each ton over 2,100 tons. •Said rates, of dockage shall be for each day of twenty-four (24) hours, provided’ that a proportionate amount shall be col­lected for fractions thereof, with a mini­mum charge of thirty-three and one-third per cent (33 1-3%) of one .day’s dockage for-vessels engaged m .coastwise trade, and a minimum of one full day’s dockage for vessels engaged in 'foreign •trade; provided,; however, the provisions of this section shall not, apply to . any vessel, operated exclusively as a police or fire boat a*t LOs Angelas Harbor, nor to any vessel while the same is actually engaged in police or fire service, in said harbor, or in patrolling said harbor for either of such purposes, and may be waived for Government vessels. See. ? 3. I t . shall be unlawful for any person, firm or corporation, owning or operating any wharf in Los Angeles H ar­bor to fail, refuse or neglect to pay, on or before July 1, 1914, the license fee pro­vided for and fixed in Section 2 hereof; and it shall be unlawful for any person, firm or corporation, whether as principal, agent, clerk, servant, or employee, to take, charge, collect or sue for any wharf­age, dockage or handling charge without first having paid the license fee herein fixed for said wharf and having also pro­cured and received the license so to do, as in this ordinance provided. E very per­son, firm or corporation violating any pro­vision of this ordinance, .shall be deemed guilty of a misdemeanor, and upon con­viction thereof shall be{ puniB'haMe by a fine of not more than three /hundred dol­lars ($300.60), or by imprisonment in the city jail for a' period of not more than' ninety (96) days, or by both such fine and imprisonment. Sec. 5. It shall be unlawful for any person, firm or corporation, whether as principal, clerk, servant, agent, o’K cm- , ployee, to charge any greater or less rate for wharfage, handling or dockage,.'than that fixed by thas Ordinance and every person, firm or corporation who shall make such charge in excess Of or less than. the. wharfage, handling, and dockage rates herein fixed shall be deemed guilty7 of a misdemeanor, and iipon conviction thereof shall be punishable, as provided in Section 4 hereof. ~ " '? Sec,. 6. Every charge for toll, wharf­age, handling or dockage, without- a lic­ense, and each charge for wharfage, handling or dockage in excess of or less than the rates herein fixed, shall >be deemed a separate, offense, and shall be punish­able- as herein provided. Sec. 7. The provisions of tfils ordi­nance fixing rates shall apply to owners of wharves, as. herein stated, to their lessees, or lessors, their agents and assigns, and where two or more wharves are-owned by the same company, herein named, $fep same rate shall apply to all wharves of said company unless herein provided. .Sec. 8. Sec. 9. • A copy o f this ordinance shall be conspicuously posted on ea-ch publ-c wharf o f each . wharf ? owner in the City of Los Angeles by the person, firm or corpor­ation owning or controlling the same. iSec. 10. This ordinance i© required for the imm'ediate preservation o f the. public peace, health and safety, and the follow-ding is a specific statement showing such urgency, to wit: This ordinance provides for the prompt payment and collection o f a large part of the revenue o f The C ity of Los Angeles necessary to defray the cost of conduct­ing the government thereof; and further provides, for a regular, orderly and sy©^ tematic method and scale of rates for dockage, and o f charges for handling - freight at and about the wharves, piers, and quays of persons, firms or corpora­tions owning or operating the same_ at the Harbor o f Los Angeles, and the City Clerk shall certify to its passage by a three fourths vote, and cause the same to be published once in The Los Angeles Daily Journal and thereupon and there­after it shall take .effect and be in force.
