y. ' \ ( COPY ) NOTICE OF PROTEST TO: The Public Service Commission State of Nevada Carson City, Nevada Re: Las Vegas Land and Water Company Charges for Water for Refrigeration Machines. The undersigned, Cornet Stores, hereinafter called the Protestant, hereby protests the revised tariffs submitted by the Las Vegas Land and Water Company under date of October 14, 1952, to become effective December 1, 1952, upon the grounds hereinafter stated, and said Protestant does hereby represent and allege as follows: 1. That said Protestant is a corporation authorized to do business in the State of Nevada, and is doing business at Fourth and Fremont Street, Las Vegas, Nevada. 2. That the Las Vegas Land and Water Company is a corporation authorized to do business in the State of Nevada, and is engaged in the business of supplying water to the inhabitants of the City of Las Vegas, Nevada, and in such capacity is a public utility. 3. That the rates and charges provided for in said revised tariff for water used by Protestant in its refrigeration machines, which are for cooling its store building and offices, is arbitrary and exorbitant and has no reasonable relation to the quantity of water so used or the purposes for which used. 4. That said Las Vegas Land and Water Company does, in addition to the charges herein referred to, assess and receive compensation for the water used on the premises of Protestant, consisting of a store building and offices, and said refrigeration machine does not use an additional amount of water sufficient to effect detrimentally or make unfair the compensation so received by them. However, the increased charges assessed by the Las Vegas Land and Water Company are thereby rendered unreasonable and unfair. - 1 -
