Maag Recommendation for Las Vegas Land and ¥ater Co. authority to construct, at Company's expense, 920 LF of 8“ cast iron water main replacing 610 LF of 8" cast iron water main located on property vacated by the City of Las Vegas on the south side of Charleston Blvd. between 13th and 15th Streets, Las Vegas, Nevada, at an estimated cost of $6410 of which $6310 is charge­able to investment. Credit to investment account for property retired of $1640.29 resulting in a net charge to investment account of $4670. The City of Las Vegas has vacated a portion of Charleston Blvd. between 13th and 15th Streets, in which area the Las Vegas Land and ¥ater Co. has an 8" pipe line, and has served notice on the ¥ater Co. to relocate this pipe line to a position within the limits of the remaining dedicated area of Charleston Blvd. In its notice the City of Las Vegas quotes provisions contained in Paragraph 2 of Permit granted the Las Vegas Land and ¥ater Co., which is covered by our Contract Audit #7461 dated February 25, 1930, and which states as follows: "The municipal authorities shall also have the right to direct tjae change in location at any time of such pipe lines, water mains, laterals and appliances and to establish and change the grade of said streets, avenues and alleys". In order to comply with the City's notification, I recommend authority to proceed with new pipe line construction replacing the portion of existing pipe lines. Approval of Las Vegas Valley ¥ater District under provisions of Section 13, paragraph (b) of Agreement CLD 11342, dated June 1, 1953 has been obtained. Mr. Bennett sees no legal objection.
