Malburg CLAIM FOR INJURY Marie M. Coleman ASSESSMENT DISTRICTS Standard Method ORDINANCE NO. 394 Legal Opinion An ordinance entitled: AN ORDINANCE DECLARING THE DETERMINATION OF THE BOARD OF COM­MISSIONERS OF THE CITY OF LAS VEGAS, NEVADA, TO MAKE CERTAIN IMPROVEMENTS IN THE CITY OF LAS VEGAS BY INSTALLING A SANITARY SEWER IN THE SAID CITY; PROVIDING THAT THE COST AND EXPENSE THEREOF SHALL BE PAID ENTIRELY BY SPECIAL ASSESSMENT UPON ALL THE LOTS INCLUDED WITHIN THE SPECIAL ASSESSMENT DISTRICT HEREBY ESTABLISHED ACCORDING TO THE BENEFITS; AND OTHER MATTERS RELATING THERETO, was read by title and referred to Com­missioners Bunker and Moore for report. Commissioner Moore moved that the protest of payment of sewer rental fees by A. L. Worswick be ordered filed. Motion seconded by Commissioner Peccole and carried by the following vote: Commissioners Bunker, Moore, Peccole and His Honor Mayor Pro Tem Whipple voting aye; noes, none. Absent: Mayor Cragin. Commissioner Moore moved that the recommendation of the City Manager that Dan Jacomini, J. M. Ritter and Richard G. Beemer be appointed on the Plumbing Board be approved. Motion seconded by Commissioner Peccole and carried by the following vote: Commissioners Bunker, Moore, Peccole and His Honor Mayor Pro. Tem Whipple voting aye; noes, none. Absent: Mayor Cragin. Commissioner Moore moved that upon the recommendation of the City Manager the bid of Paul Vukich Co. on the Approach Outfall Sewer in the total amount of $25,870.00, being the low bid, be accepted. Motion seconded by Commissioner Bunker and carried by the following vote: Commissioners Bunker, Moore, Peccole and His Honor Mayor Pro Tem Whipple voting aye; noes, none. Absent: Mayor Cragin. Commissioner Moore moved that the first payment on the Sewage Treatment Plant, Unit No, 1 in the total amount of $40,450.95 be allowed. Motion seconded by Commissioner Bunker and carried by the following vote: Commissioners Bunker, Moore, Peccole and His Honor Mayor Pro Tem Whipple voting aye; noes, none. Absent: Mayor Cragin. Commissioner Bunker moved that the claim of R. F. Malburg in the amount of $213.00 be re­ferred to the City Manager for investigation and report. Motion seconded by Commissioner Peccole and carried by the following vote: Commissioners Bunker, Moore, Peccole and His Honor Mayor Pro Tem Whipple voting aye; noes, none. Absent: Mayor Cragin. Commissioner Moore moved that the latter from William G. Ruymann dated December 8, 1949 relative to the injury of Mrs. Marie M. Coleman in front of the Post Office be ordered filed. Motion seconded by Commissioner Bunker and carried by the following vote: Commissioners Bunker, Moore, Peccole and His Honor Mayor Pro Tem Whipple voting aye; noes, none. Absent: Mayor Cragin. Commissioner Moore moved that the recommendation of the City Manager and City Engineer to use the St. Louis Plan as a standard method of pro-rating assessment costs in special assessment districts be approved. Motion seconded by Commissioner Bunker and carried by the following vote: Commissioners Bunker, Moore, Peccole and His Honor Mayor Pro Tem Whipple voting aye; noes, none. Absent: Mayor Cragin. Commissioner Bunker moved that the City Manager be directed to send a copy of the opinion of the City Attorney on the legality of Ordinance No. 394 to the Carpenters & Joiners of America. Motion seconded by Commissioner Moore and carried by the following vote: Commissioners Bunker, Moore, Peccole and His Honor Mayor Pro Tem Whipple voting aye; noes, none. Absent: Mayor Cragin. There being no further business to come before the meeting at this time Commissioner Moore moved this meeting adjourn.
