October 6, 1953 Fii® rr-3 Franklin f # Hamilton, Esquire C’Keiveny A Kgmxm %33 South Spring Street Las Angeles 13, California Dear Frank# The Baiiroad Company is negotiating for the sale to the City of Las Vega® of a parcel of land underlying pipe line shown by red line between points marked ## and Q on Exhibit '’A* attached to the agreement dated June 1, 1953# between LA&8L, UMBR# LVL&kCompany and Las Vegas Valley water District covering the sale of the water system at Las Vegas# Nevada. The lailroads are obligated, under subparagraph (k-6) of paragraph tltj of Section 1 of the agree* went,to grant am easement 15 feet In width to the District for the pipe line between points JJ and Q. That pipe line is owned by the las Vegas Land and Hater Company. The sale to the City of Laa Vegas of the land underlying this pipe line will take place prior to the conveyance of the water system to the District. Therefore it appears that the appropriate way to protect the Interests of the District is for the Railroads to grant to LVLMfCcm- pany (prior to the conveyance of the underlying land to the City) an easement, 15 feet in width, for the pipe line between points 33 and Q by a document in the form of the easement, marked Exhibit :F % attached to the agreement of June 1, 1953# The conveyance of the land to the City would then he subject to the easement in favor of the LVL&WCom- pany, which would he ultimately transferred by the LVL&W Company to the District in fulfillment of the obligations
