The Pardon Attorney's office has advised me that they have all the information necessary to make a recommendation to the President, however, Mr. Binion's application is one of many that they receive and that the normal course of their consideration on these applications result in their submitting the recommendation approximately 18 to 24 months after the application has been filed. Since Benny's application has only been pending 13 months, he has approximately 6 to 10 months to wait. They feel no obligation to give Benny's application any special consideration over the hundreds they receive from thieves, murders and other convicted felons. Despite inquiries from yourself as well as Senator Laxalt and Congressman Reid, the Pardon Attorney's office feels no compulsion to move this application along. Because of Benny's precarious health and his strong desire to have his pardon during his lifetime, it would appear to me that it will take an inquiry from the Oval Office to move this application. Benny is fully aware of the status of this matter, the efforts being made on his behalf and the results thereof. Benny is most appreciative of the efforts that you have made on his behalf and such additional assistance you can render in the expeditious handling of his application. /ours, UIRE
