1 Section 11. It Is understood that the Water Company has 2 outstanding contracts with certain subdividers or applicants for 3 water service made pursuant to Rule 9 of its said Rules and Regu- 4 lations under which such subdividers or applicants 5 (a) have deposited sums of money with Water Com- 6 pany as advances for the construction by the Water Com- 7 pany of certain water mains, or 8 (b) have at their own expense constructed and 9 conveyed to the Water Company certain water mains to 10 serve properties developed or being developed by such 11 subdividers or applicants subject to refund of the cost 12 pursuant to the Rules and Regulations of the Water Gom- 13 pany on file with the Public Service Commission of the 14 State of Nevada. ^-5 Water Company hereby assigns to the District, effective 16 on the sale date, all such contracts which upon said date are still 17 wholly or partially unperformed, and the District hereby agrees, 18 effective as of the sale date, to assume all liabilities, including 19 liability for further refunds under said contracts, and to indemni- 20 fy and save harmless the Water Company from any liability for re- 21 funds under said contract subsequent to the sale date. The Dis- 22 trlct hereby agrees to assume, effective as of the sale date, all 2^ liability under said contracts with respect to any unexpended por- 24 tions in the possession of the Water Company upon the sale date of 25 sums of money deposited with the Water Company under such contracts 26 as advances for the construction of water mains. 27 28 ko
