    Las Vegas - November 18, 1943 W 16-3-4 Mr. Leo A. McMamee: I assume you have seen the "Invitation to Bid" by the City of Las Vegas, for the use of water from the new disposal plant and farm land adjacent thereto, belonging to the City. For ready reference I attach copy of the advertisment. I have discussed this with Mr. Strong on his last trip here, and we feel that steps should be taken to protect our right to the water from the Old Septic tank. You will recall that in March, 1942 the City requested a 10-acre aite and after considerable negotiation the 10 acres were finally condemned by United States Government in March of this year. However, the agreement between ourselves and the City, under which they are to deliver one million gallons per day from the Old Septic tank, is still in effect so far as I know. For ready reference I quote from my letter May 26, 1943 on the subject of drawing a new lease with Will Stewart on Las Vegas Ranch; "I think it is extremely important that we file a formal application with the Stete Engineer at the earlieat possible date for permission to use the water from the present septic tank. I appreciate the fact that this may not be a legal requirement but nevertheless, it will give us the advantage of having filed a prior application in case the City of Las Vegas, due to a change in the present political situation may at some time in the future desire to divert the water from its present delivery at the five-acre disposal site, and instead file on the water themselves for delivery through the new ten-acre disposal site." As I understand it we can secure the right to only that portion of water which we place to beneficial use. Mr. McNamee -2- November 18, 1943 I suggest we file on one million gallons per day from the Old Septic tank, and thereby avoid the possibility of a prior application from some other party. Walter R.
