Description

Lessees of the Las Vegas Ranch quit paying their rent when the water to the ranch quit flowing. Upon being reminded of the terms of the lease, they paid the rent, but asked for future water delivery plans.

    Las Vegas - November 17, 1950 W 18-1-12-A Mr. Wm. Reinhardt: ( cc - Mr. E. E. Bennett ( cc - Mr. C. M. Cory Referring to my letter July 21 regarding water for the Las Vegas Ranch. The Auditor wired me a few days ago that the Lessee of the ranch, Mr. W. T. Stewart, was delinquent in rental in the amount of $1,666.67, covering the period from July to November 1950 Apparently the rental payments had stopped about the same time as the deliveries of water by the City were discontinued. I called at the ranch but Mr. Stewart was out of town; however, the following day Dell Stewart and Earl Leavitt, who are joint Lessess, called at the office with their attorney and stated they were under the impression that they were not required to pay rental as long as no water for irrigation was available. I had their attorney, Mr. Rulon Earl, read the terms of the lease to them and he then advised them they would have to pay the rental regardless of water delivery but they, of course, had the option to terminate on six months notice. They then paid the full rental which I remitted to the Auditor. However, they asked me to ascertain whether any arrangements could be made to deliver them water from the new disposal plant so they could determine what plans to make for the future. The grass and hay has died for lack of water but in the event our Company does not plan to make arrangements for delivery of water they would be willing to pay $150 a month for water on the premises during the remaining term of the lease, which would give them time to move their holdings to some other location.
