V elusive of supervision and engineering, is the sum of Three Hundred Twenty Thousand Dollars ($320,000.00). Within the time and in the manner provided in Section § hereof the District shall deposit in the escrow referred to in Section 7 said sum of Three Hundred.Twenty Thousand Dollars ($320,000.00) plus a sum equal to ten percent (10$) thereof, the total of both of said sums being the aggregate amount of Three Hundred Fifty-two Thousand Dollars ($352,000.00). (Said aggregate amount of Three Hundred Fifty-two Thousand Dollars ($352,000.00) is herein sometimes referred to as Relocation Fund".) The escrow instructions referred to in Section 7 shall provide for disbursements by the Escrow Agent from said Relocation Fund pursuant to the provisions of this Section 5. It is agreed that if payments are made from said Relocation Fund for materials supplied or work performed pursuant to a contract or contracts entered into by the First Parties, said First Parties shall be entitled to receive the payments from said Relocation Fund for services rendered by the First Parties as follows: (1) If it shall be necessary for the First Parties both to prepare plans and specifications for the performance of any contract or contracts entered into by said First Parties and to inspect the work called for by said contract or contracts during construction, said First Parties shall be entitled to a sum equal to ten percent (10$) of the payments made pursuant to said contract or contracts, said sum to represent compensation for preparation of the plans and specifications and inspection of the work during construction, including any surveying and engineering'necessary therefor. (2) If the First Parties shall use plans and spe-ications prepared by the District and approved by the First Parties, said First Parties shall be entitled to a sum equal to five percent (5$) of the payments made pursuant said contract or contracts, said sum to represent compensation for inspection during construction,including any surveying and engineering necessary for said construction. From time to time as amounts become due and payable under the terms of a contract or contracts entered into for the supplying of materials for or the performance of all or any portion of the work provided for in this Section 5* the party to this agreement who shall have entered into such a contract or contracts shall ex- 19.
