Ordinance No. 20,938 (N ew Series) An Ordinance -fixing the rates for wharfage upon the wharves in the harbor of Los Angeles, fixing the rate's for; dockage at said wharves, and the Charges for handling freight over said wharves, providing- for the licenses for taking tolls on said wharves and prescribing the amount of such licenses.. The Mayor and Council of the City of Los Angeles do ordain as follows: Section 1. That the fair cash value of each' of the wharves in the City of Los Angeles, and the cost of maintenance and repair thereof respectively is hereby fixed as follows: That the value of the wharf of the Southern Pacific Company is hereby fixed at Tw o, Hundred Twenty-eight Thousand, F ive Hundred ($228,500) Dollars,' and that the cost o f repair and maintenance of said wharf is hereby fixed at Twenty-two Thousand, Eight Hundred F ifty ($22,850) Dollars; That the value of the wharf of the San Pedro Lumber Company is hereby fixed at Thirty-seven Thousand Seven Hundred F ifty ($37,750) Dollars, and that the cost of repair and maintenance of said wharf is hereby fixed at Three Thousand Seven Hundred Seventy-five ($3775) Dollars; That the v a lu e ,o f the wharf of the KerckriofLCuzner Mill and Lumber Company is .hereby fixed at Seventeen Thousand <$17,000) Dollars, and that the cost of repair and maintenance of said wharf is hereby fixed at Seventeen Hundred ($1700) Dollars; That the value of the wharf of the San Pedro Dock Company is hereby fixed "a t Eight Thousand Six- Hundred F ifty ($8650)/ Dollars, and that the cost of repair and maintenance -of said wharf , is hereby fixed at Eight Hundred Sixty-five ($865) Dollars; That the value of -the wharf o f the Southern California Lumber Company is hereby fixed at Twenty-six-Thousand Six Hundred- Eighty ($26,680) Dollars, and that the cost o f repair and maintenance o f Said wharf is hereby fixed at Two Thousand Six Hundred Sixty-eight ($2668) Dollars; That the value of the wharf of the San Pedro, Los Angeles and Salt Lake Railroad Company is hereby fixed at Seventy-five Thousand One Hundred Twenty ($75,1-20) Dollars, and that the cost of repair and maintenance of said wharf is hereby fixed at Seven Thousand Five Hundred Twelve ($7512) Dollars; That the value of the wharf of the Crescent W harf and ‘Warehouse Company is hereby fixed at Nineteen Thousand Seven Hundred Ten ($19,710) Dollars, and that the cost of repair and maintenance of said wharf is hereby fixed at Nineteen Hundred Seventy-one ($1971) Dollars; That the value o f - the wharf o f the National Lumber Company is hereby fixed at Twelve -Thousand Six Hundred Twenty ($12,620) Dollars, and that the cost -of repair and ?maintenance o f said wharf is hereby fixed at Twelve Hundred Sixty-two ($1262) Dollars; That the value of the wharf of the Consolidated Lumber Company is hereby fixed' at Fifteen Thousand ($15,000) Dollars, and that the cost of repair and maintenance of said wharf is hereby fixed at Fifteen Hundred ($1500)' Dollars; That the value of the wharf of the Pacific Lumber Company is hereby fixed at Forty Thousand ($40,000) Dollars, and that the cost of :repair. and maintenance o f said wharf is hereby fixed at Four Thousand ($4000) Dollars. T h at whenever the handling o f any of said merchandise is. done by the crew of any vessel tha rate charged for handling the same is hereby fixedv at one half of the rates above specified, and such charge shall be applied to shipments transferred from one vessel to another vessel without the use of a wharf. " That, the rate o f wharfage upon all freight or .merchandise other '-than that which is herein given at a different rate, shall be ten- (10) cents per ton o f two thousand (2000) pounds, and a reasonable charge for handling the -same, not to exceed the actual cost of the labor employed. Sec. 3. That for the use o f any wharf the person, firm or corporation owning or operating the same is hereby-" authorized to charge the owners of vessels for the privilege of making fast to said, wharves the following rates, commonly called “ dockage” , to wit: R A TE S OF DOCKAGE. Sec. 4. Before any person, firm or corporation owning or operating any wharf shall charge,-sue for or collect any toll or wharfage or dockage, such person, firm or corporation must - procure from the City Clerk of the-City of Los Angeles a license authorizing him to take tolls, wharfage or dockage for the period ending June 30, 1911; and •'said license shall be issued to such person, firm or corporation by the said City Clerk upon the payment -of the license fee herein fixed for the said wharves respectively, as follows, to wit:- Southern Pacific Company ......... $4500.00 Kerckhoff-Cuzner Mill & Lumber Go., . . . . . . . . . . . Sec. 5. It shall be unlawful for any per-fson or persons,whether as principal, clerk, servant, -or agent, or employee, to take, or-charge or collect, or sue for, any wharfage o f dockage for the use of the said Wharves, or any wharf, without first having paid the license fee herein fixed, for said wharf, and having' procured the license so t o , do, as in this ordinance provided. And every person who shall violate any of the provisions of this ordinance relating to the taking of tolls,, wharfage or dockage, without a license, shall be deemed guilty of a misdemeanor, and is punishable by imprisonment irn the City Jail for a period not exceeding ninety (90) days, or by a fine not exceeding Three Hundred ($300) Dollars, or by both such fine and-imprisonment. Sec, 6, It shall be unlawful for .any person dr persons, whether as principal, clerk, servant, agent or employee,.' to charge any greater or less rate for wharfage or dockage than that fixed by this ordinance'. And every person who shall make such charge, in excess of or less than - the rate' - fixed, shall be deemed guilty of a misdemeanor, and is punishable as provided in Section 5 hereof. See. 7. Every charge for toll, wharfage or dockage, without a ' license, and each Charge'1 for wharfage or dockage in excess Of o r 1 less than the rate herein fixed shall be ..deemed a separate offense, and shall be punishable as herein provided. Sec. 8. The provisions of this ordinance fixing rates shall apply to owners thereof, as herein stated, to their lessees,1, or lessors, their agents and assigns, and where two or more wharves, are owned by the same company,' herein named, the same rate shall apply to all wharves of said company unless otherwise herein provided. ' Sec* 9* The’ license fee for any wharf not herein expressly mentioned, shall be, ahd is hereby fixed at One Hundred ($100) Dollars per annum. Sec. 10. It -shall be the duty of. the City Attorney of the City of Los Angeles to assist th e 'T a x and License Collector of the City of Los Angeles in; the collection of th&felicense' fees herein fixed; and it shall be* the duty of the City Attorney to bring suit for thev recovery thereof, against any person or persons, corporations Or co-partnerships, required by this ordinance to procure - a license, who Charges o f attempts to charge wharfage, dockage or 1 tolls f o r ' th e; use of any of tile wharves herein mentioned; such suit shall be brought in the name of the City of Los Angeles; , Sec. 11. A copy of this ordinance shall be mailed by the Clerk o f the C ity o f Los Angeles to each of the wharf owners herein named, and a printed or written copy thereof shall be j conspicuously, posted on each public wharf of each wharf owner in the City o f Los Angeles by the person or corporation owning and controlling the same. Sec. 12. A ll ordinances- and parts of ordinances in conflict herewith are hereby repealed. SeCv 13* This ordinance is urgently required for the immediate preservation of trie public peace, health and safety; and the. City Clerk shall certify to its passage by a two thirds vote of the Council, and cause it to be published once in The Los Angeles Daily Journal and thereupon and thereafter it. shall take e ffect and be in force. , I hereby certify that the whole number of members of the City Council of the City of Los Angeles is nine, and that the foregoing ordinance was passed by a two thirds vote of Said Council, at its meeting of September 20, 1910,. by the following vote, to wit: Ayes: Messrs.
