F a ilu re to comply w ith the p rovision s a fo resa id as to dredging s h a ll g iv e the grantee the r ig h t to withdraw from said wharf, whereupon the c it y s h a ll refund to the grantee the balance o f any advances made and remaining unearned at the time o f sueh withdrawal, but s h a ll not en­t i t l e the grantee to claim any damages against said c it y re s u ltin g from such fa ilu r e . the a fo re s a id four hundred (400) fo o t extension o f said wharf, and a tr a n s it shed one thousand (1000) fe e t long and one hundred (100) fe e t in width on said wharf, and i t s extension, at the e a r lie s t p ra ctica b le date, and w i l l also provide and maintain a paved or macadamized road­way lead in g from said wharf to improved roadways extending to the main business d is t r ic t o f the C ity o f Los Angeles, and at le a s t two (E ) depressed r a ilr o a d tracks along the w e sterly side o f such tr a n s it shed, and a surface r a ilr o a d track alohg the fr o n t o f said wharf, said tracks to be connected w ith at le a s t one tran scon tin en tal r a ilro a d . provided, during the term o f th is perm it, pay ti> the G ity o f Los Angeles, annually fo r the b e n e fit o f the Harbor Revenue Fund o f said c it y , or such other fund as may h e re a fte r be estab lish ed fo r the purpose o f pay­ing the, expense o f conducting the Harbor Department o f said c it y , and o f m aintaining and operating the harbor o f said c it y , in law fu l money o f the United S tates, as compensation fo r the use, operation or F ift h : That the said c it y w i l l also construct and complete S ixth : That the grantee o f th is permit s h a ll, as h e re in a fte r - 4 -
