Deed Audit No. 979 S.P.,L.A.& S.L.R.R. CO A 1471 H. I. B. . MAY 11 1909 This agreement made the 15th day of January in the year of our Lord one thousand nine hundred and nine, by and between the NEVADA-UTAH MINES & SMELTERS CORPORATION, a corporation incorporated under tie laws of the State of Maine, and OHIO-KENTUCKY CONSOLIDATED MINING COMPANY, a corporation incorporated under the laws of the State-of Nevada, known and designated hereafter as party of the first part; and the CALIENTE & PIOCHE RAILROAD COMPANY, a corporation incorporated under the laws of the State of Utah, known and designated hereafter as party of the second part, W I T N E S S E T H : That the parties hereto, for good and valuable consideration, the receipt whereof is hereby acknowledged, have agreed to and with each other as follows:- First: Said party of the first part agrees to furnish said party of the second part, its successors and assigns, a supply of water, up to and not exceeding fifteen thousand gallons daily, to be used solely and exclusively for railroad purposes. Second: Said supply of fifteen thousand gallons of water daily shall not be cumulative, and shall not exceed fifteen thousand gallons for the twenty-four hours designated as a day; and said supply shall be measured by a water meter or meters, which said meter or meters shall be under the control of the duly authorized agent of the party of the first part and open for inspection at all times. Third: Said supply of water shall be subject to the obligation of the party of the first part to at all times keep a fifty thousand (50,000) gallon tank filled with water for use by the inhabitants of the town of Pioche, in Lincoln County, in the State of Nevada, in case of fire or fires occurring in said town of Pioche, and in case of such fire or fires in said town to turn over to the said County of Lincoln, the control of the water supply of said
