% May 15, 1950 174-2 Mr* Jo. 5. Martin Lincoln County Power District Mo. 1 Pioohe, Nevada* Dear Mr. Martin? I am in receipt of copies of correspondenoe passing between Mr. Cunningham, Superintendent of the Railroad and yon relative to charges assessed for water by the Power District against the Railroad. I note that your letter of April 6th to Mr. OLA. Cunningham attaches a copy of the schedule of rates charged by the Power District and also states that it has been the policy of the Power District to place meters upon every outlet. I also note that you state the Public Service Commission of Nevada- has refused to pass upon the rate schedule. It is not quite clear to me whether the rates shown on the schedule are metered rates with a minimum in the amount shown on the schedule or Aether they are flat rates and the item for metered rates is Intended to be an omnibus item covering all services not specifically Included in the schedule of rates. 1 am making this inquiry because Mr. Cunningham has asked whether It would be necessary for the company to enter into an agreement with the Power District. Ordinarily, where public utility rates are fixed by the Public Service Commission, no con tracts of course are necessary but on the other hand, where rates are not so fixed we occasionally find it desirable to make oontraots. I would appreciate It if you would advise whether you have any oontraots with any other users under the Jurisdiction of the Power District and Aether the schedule of rates furnished Mr. Cunningham are metered rates with a minimum or flat rates.
