I agree.Ho.2. when the land over which the pipe lin e is la id , is taken up by individuals. Several persons have "been in possession of the premises at various times without the sanction of this Company and they have used water from the springs which has not been used hy the railroad company. The Railroad Co. carries through it s pipe lin e , considerably more water than i t requires for railroad purposes and wastes the surplus "below the station at Modena. While no formal action has "been taken, i t has "been generally understood hy this Company that it s t i t le to the land is n i l. It occurs to me that i f the Company is to adopt this view as fin a l, we should take formal action and re tire the same from our accounts. This property was p articu larly included in the mortgage.
