I assume that the lands in question are embraced in the B irst Mortgage o f the Company, dated July 1st, 1903, (See pp.23-45 * Rower o f the Trustee under said mortgage, to release property embraced therein from the lie n thereof, is defined in A rticle VI of said Mortgage (See pp.73-7), and the property in question cannot be released from said mortgage, except upon the procedure by the R ailroad Company and its o ffic e rs therein pointed out. Before any steps, however, are taken by the Company in that d irection, I think it would be advisable to know what the water rights and water properties are which are embraced in the mortgage, or owned by the Company, whether embraced therein or not. I think i t would be w ell to have the t it le deeds of the Company examined, and to consider whether or not any or su fficien t steps have been taken to safeguard the Company’ s t i t le to the water righ ts, Independently of the land rights, before anything further is done in the matter, and to this end I would thank you to have examined the records of the Company i f necessary, upon this point.
