In the event that the regulations and. restrictions on delivery and consumption of* water adopted pursuant to this act conflict with any law establishing the rights of individual consumers to receive either specific or proportionate amounts of the water supply available for distribution within such service area, the regulations and restrictions adopted pursuant to this act shall prevail oyer the provisions of such laws relating to water rights for the duration of the period of emergency* provided, however, that any distributor of water which is subject to regulation by the State Public Utilities Commission shall before leaking such regulations and restrictions effective secure the approval thereof by said Public Utilities Commission* SIC. V. nothing herein contained shall be construed to prohibit or prevent review by any court of competent jurisdiction of any finding or determination by a governing board of the existence of an emergency or of regulations or restrictions adopted by such board, pursuant to this act, on the ground that any such action is fraudulent, arbitrary or capricious. SiiC. This act is an urgency measure necessary for the immediate preservation of the public peace, health or safety within the meaning of Article I if of the constitution and shall go into immediate effect. The facts constituting such necessity ares In many sections of California the supply of water available for distribution by distributors of public water is depleted, both as the result of inadequate rainfall and expanding consumption, to the point where the ability of the water distributors to provide sufficient water within their distributing area for domestic use, sanitation, and fire protection purposes is endangered until such time as the public water supplies are either replenished or augmented. In order that the minimum requirements for human consumption, sanitation, and fire protection can be met from existing supplies, it is essential that water distributors be given the right to restrict consumption within their service areas to meet such immediate necessity for the protection of public peace, health and safety without regard to the ordinary rights of consumers of a public water supply to proportionate us© of such supply, regardless of the character of such use.
