V proceedings, recoveries, awards and judgments of every nature and description, including attorneys* fees and cost presented, brought or recovered against the Railroad Company, which may arise or grow out of any of the work performed under this agreement. 9, It is understood and agreed that you will commence work within thirty (SO) days from and after the date of this letter agreement and shall handle the work hereunder in an expeditious and workmanlike manner to the satisfaction of the Railroad Company, or its representative, 10, It is agreed and understood that your employes are not and shall not be considered as employes of the Railroad Company. 11, The location of the facilities to be installed shall be as indicated on attached Drawing, 12, You further agree to furnish surety bond in an amount not less than One Thousand Two Hundred and Ho/100 Dollars (^1,200.00), in the form attached hereto and conditioned upon the faithful performance of the work herein contemplated, 13, You shall procure and cause each subcontractor, if any, to procure from a duly licensed agent of an Insurance company to be designated by the Railroad Company, Contractor’s Public Liability and Contractor’s Property Damage Insurance. The policy or policies to be taken out by you shall provide limits (which have been designated by you): (a) Under Contractor’s Public Liability Insurance, of $25,000,00 for any one person; and subject to the same limit per person, $50,000,00 for any one accident; such insurance to protect you and each subcontractor against claims for injuries to or death of persons, other than your own employes, arising out of the work to be performed under this contract; (b) Under Contractor’s Property Damage Insurance, of $5,000.00 for any one accident, and subject to the same limit per accident, #10,000.00 aggregate during an annual period; You shall procure from a duly licenced agent of an insurance company to be designated by the Railroad Company, Contractor’s Contractual Liability and Contractor’s Con-tractural Property Damage Insurance.
