Mr. Walter R. Bracken, Vice-President of the Las Vegas Land and Water Company and Agent of the Union Pacific Railroad Company, having requested on behalf of said Las Vegas Land and Water Company and said Union Pacific Railroad Company that the Board of County Commissioners grant its permission for the excavation of a trench five feet deep extending along the northern gutter of Charleston Road from a point about one mile west of the Clark County General Hospital, thence easterly about 10,000 feet underneath the railroad track of the Union Pacific Railroad Company to a connection at Main Street and Charleston Road, on motion duly made, seconded and carried, IT IS HEREBY RESOLVED -that a permit be, and it is hereby granted to said Union Pacific Railroad Company and to said Las Vegas Land and. Water Company to excavate said trench for the purpose of installing additional water mains to augment the; water supply of the City of Las Vegas, Clark County, Nevada, the excavation of the said trench to begin on or about October 1, 1945, together with permission in the meantime to drill test holes five feet, or thereabouts, in depth on the north side of Charleston Road for the purpose of determining the character of excavation necessary. It is expressly understood that this permission is granted only so far as said proposed excavation is on property of Clark County and on the further express condition that the Permittees will protect and cover all holes and excavations at the earliest feasible time and on the condition that the Permittees indemnify the County of Clark, State of Nevada, from and against any damages which may accrue to Clark County, Nevada, by reason of any law suit or claim which may be filed arising out of any injuries of any character whatsoever resulting from the excavation of either
