•«* W 23-4-4 March 4 # 1953® MEMORANDUM FOR FILE Referring to attached Print a-1082 dated January 23* 1953 on which is indicated proximate location of existing build­ing over 4” pipe and also proximate location of building under construction on the west side of 5th Street on lot N, Park Place Addition, Las Togas, Nevadat 1. On February 24th Mr. Doyle, Superintendent, noticed that building was under construction on location indicated on Print, and, knowing that we had a pipe line at location of this building, stopped on the job and informed the contractor’s forces construct­ing the building that it was being constructed over pipe line owned by the Las Vegas Land and Water Company. He was informed that they were merely the contractors and were constructing the building under orders from the Owner. Mr. Doyle then reported the facts to me, and, early on the morning of February 25th I went to the job ana discovered that footings for proposed building had been excavat­ed and that pipe line lay approximately 4* or 5* within the limits of the proposed building, at a depth of about 2§® below ground. 2. Hie following information was obtained from notices post­ed on the existing building located adjacent to the proposed build­ing as Indicated on the Print. This existing building is also lo­cated over the LVL&WC pipe lines (a) City building permit was issued to Valley Enterprises, Inc. (b) Purchaser, M.C. MaePack, President of prises, Inc. the Valley Enter­( e) Notice of non-responsibility by the owners Indicated that title holders were George W. and Idith A. Page, Lot N, Park Place Addition, except south 113* measured along the east boundary, recorded in Book 1, Page 40 of Plats. 3* The field force reported that workers on the job had stated that Sir. Mac Peck had a clear title to the property and that no reserva­tion had been made for pipe line easement. Deed is now in Escrow. 4. Our records were immediately investigated, and it was found that the LVLANC is the holder of an easement 1C* in width along the north line of Lot N from 4th to 5th street, recorded in Book 3“ of Deeds, Pages 36-39, over which the existing building has already been constructed and the new building is under construction.
