In the event that the Water Distriet does not provide works or facilities to receive delivery of water under this agreement by January 1, 1957* BMI in its discre­tion may terminate this agreement upon giving thirty (30) days* written notice to the Water District and upon such termination neither party hereto shall be liable to the v other for any costs incurred In connection with this agree­ment. EMERGENCY STAND-BY SERVICE 35• After the construction by the Water District of works to receive delivery of water from said Water Faci­lities pursuant to this agreement, the parties hereto agree during the term of this agreement to furnish each other emer­gency stand-by water service for the purpose of protection of public health and safety and the prevention of irreparable damage toNindustrial machinery and equipment. In the event A of such emergency either party may demand delivery from the other of not to exceed eight million (8,000,000) gallons of water per day, provided that In no event shall the party
