    \ M E M 0 R A N D U M To: Mr. W.J. Schall Jan. 27, 1949 The Nevada Legislature of 1947 (Chapter 167) creates a water district in Las Vegas Valley. The Act provides that the district may acquire "by pur­chase or condemnation any property whether or not it he devoted to public use or not, and provides that in the event of condem­nation, the condemnation suit shall be carried on under the laws of Nevada. Nevada Compiled Laws, provides that proceedings under the con­demnation statutes must be brought in the District Court of the county in which the property, or some part thereof is situated. against the Las Vegas Land and Water Company and the Union Pacific Railroad Company, owners of the water-bearing lands and I wish you would check into the question, whether we are restricted to the state courts under the above mentioned pro­vision or whether, because of the diversity of citizenship in connection with the Union Pacific, we could have the case transferred to the Federal Court.
