agreement Audit No. 9982, dated April 28, 1939, expiring October 31, 1949, with Randolph Marketing Company, Lessee, covering lease of packing house, located at Truslow and Malden Aves., Fullerton, Calif.; rental $316.97 per month, payable monthly in advance; subject to termination by either party upon 90 days' written notice; be, and the same is hereby, ratified, approved and confirmed. On motion duly seconded, the following resolution was unanimously adopted; WHEREAS, by deeds, dated January 14, 1929, and March 4, 1930, LVL&WCo. conveyed to Crane Co. certain lands in Lot 1, Tract 7777, East Los Angeles, Calif., which deeds contain certain covenants, reservations, conditions and restrictions; and WHEREAS, UPRRCo. has succeeded to the right, title and interest of Land Company in and to the rights under said covenants, reservations, conditions and restrictions; and WHEREAS, Edwin W. Pauley, having taken a lease of oil and gas rights in said lands, has drilled one oil well thereon, and desires a release and waiver of said covenants, etc. contained in said deeds insofar as they affect the right to drill, operate, maintain and repair the said well and to redrill and deepen it, to drill, operate, maintain and repair one additional well into a deeper zone, and to drill offset wells; THEREFORE, BE IT RESOLVED, that the action of President and Asst. Secretary Bachman on behalf of this Company in executing agreement Audit No. 72380, dated October 20, 1949, between UPRRCo., LVL&WCo. and Edwin W. Pauley, providing for release N -3-
