    2 - Company to refund to Subdivider at quarterly intervals 35^ of revenue received by it from consumers located within Hyde Park Subdivision No. 1 taking service from the water mains so installed, for period of ten years from date of completion of said installation, or until Subdivider has been repaid the agreed-upon sum of $53,000, whichever occurs first; 3 - Owner to furnish Company easements where pipe lines are to be laid in other than dedicated streets and alleys; 4 - Company to own said water mains; 5 - Owner to furnish Company bill-of-sale for said water mains; be, and the same is hereby, ratified, approved and confirmed. On motion duly seconded, it was RESOLVED, that the action of Vice President Reinhardt in executing rider CLD No. 10962-1, dated February 12, 1953, terminating effective February 20, 1953, lease agreement Audit No. 10627, dated January 31, 1952, with Steven Carmine and Marco B. Restovich, co-partners, doing business as ”The Surf Dinner House”, expiring December 10, 1956, covering site for restaurant, located at Lime Avenue and Ocean Blvd., Long Beach, Calif.; be, and the same is hereby, ratified, approved and confirmed. On motion duly seconded, the following resolution was unanimously adopted: WHEREAS, Reed Wittwer and Gussie Wittwer, husband and wife, and Lester Wittwer and Vanola Wittwer, husband and wife, collectively called ”Second Party”, propose to construct cer­tain buildings and structures on North Main Street, Las Vegas, Nevada; and WHEREAS, said construction will encroach upon easement -2-
