in vicinity of Eighth Street and Don Julian Road, in City of Industry, California, referred to as "San Jose Creek Trunk Sewer", providing: 1 . District agrees to prepare plans and specifi­cations, to award contract, to Inspect, supervise and approve construction of said San Jose Creek Trunk Sewer and appurtenant works, without cost to Company, and with reasonable dispatch to enable Company to complete said line in usable condition within one year from date first above written. Total cost payable by Company, including costs of acquisition of rights of way, not to be in excess of $500,000.00. 2. District to obtain all necessary rights of way, including occupational rights of way. Company agrees to pay costs of acquisition thereof, if demanded by District, and said cost8, if paid by Company to District, shall be deemed an actual direct cost of construction. Company agrees, at no expense to District, to provide any necessary right of way, Including occupational right of way, across or along any property owned by it or it8 affiliates, or property owned by E. C. Woodward and Citizens National Trust and Savings Bank of Los Angeles, as Trustees under the Will of August V. Handorf, deceased. 3 . District agrees to purchase from Company, and Company will sell to District, the completed San Jose Creek Trunk Sewer, upon the following terms and conditions: (a) Company shall transfer all its right, title and interest in said completed sewer by documents of title approved by District, and District shall promptly thereafter accept said transfer of title; - 3 _
