June 12, 1953 June 1, 1953, found on page 11 thereof, it is my opinion that the language retains in the ownership of the Railroads all of the water rights appurtenant to the land conveyed and prevents the grantee thereof from developing water on said land, and that accordingly the provision above quoted complies with the provisions of Section 2 of the a- greement• Since this is the first case in which we have found it necessary to apply the terms of the agreement with the District, we should like to have you advise us whether you agree that the above quoted language inserted in the deed conveying land in the shop grounds will comply with the provisions of Section 2 of the agreement.
