Mathews Attorney General Carson City, Nevada Subjects Power of the Lae Vegas Valley Water Distrlet to Condemn Water Systems Owned by the Incorporated Cities of Worth Las Vegss and Henderson, Nevada. Dear General Mathews: On September 30th the voters of Clark County will go to the polls to approve or disapprove a bond issue to finance the proposed work of the Las Vegas Valley Water District* The Mayor and the City Council of Worth Las Vega% on the advice of their City Attorney, Mr* Elwin C* Leavitt, are opposing the bond issue because Mr* Leavitt feels that the Las Vegas Valley Water District will have the power to condemn the Worth Las Vegas municipally owned water system* I understand that Mr* Calvin Cory, Counsel for the Las Vegas Land and Water Company, and Hr, William Coulthard, Secretary of the Las Vegas Water District, have contacted you asking for an opinion from your office in this matter* These gentlemen inform me that you will be willing to render such an opinion only if requested by this office* X enclose herewith a letter dated September 9, 1953, from the law offices of O’Melveny & Myers, Los Angeles, California, Bond Counsel for the Las Vegas Valley Water District* Mr* Cory, Mr. Coulthard, and myself concur in this opinion and feel confident that you will also* As stated 'by Bond Council, under existing statutes the district may acquire by agreement of purchase a municipally owned water system but may net obtain the same by condemnation* It is imperative that an opinion from your office be handed down immediately since the uncertainty brought about by the difference of opinion between the attorneys mentioned and Mr. Leavitt may influence the voters against the bond issue* Wot only does Clark County desperately need Lake Mead water to supplement our artesian supply but unless Mevadavs allocated share of water from the Colorado liver be used we may expect the water hungry states of California and Arisona to bring pressure to bear upon Congress to reallocate the unused Wevada share.
